OFFICIAL CONTEST RULES

 

CONTEST´S PURPOSE

To Promote talented student and amateur graphic designers offering awards and visibility for the most shared graphic designs with Mybrana App and release Mybrana as a new worldwide distribution channel  for these graphic designers.

DEADLINES

The competition opens  04/01/2015, 13:00 h CET, Submissions close 04/30/2015 00:00 (CET), as proceed exposed furthermore.

ORGANIZING COMPANY

Organizing company is Mybrana Network S.L. (“MYBRANA” here and after), VAT number B-01504745, registered in Registro Mercantil de Álava, Volume 1.523, Book 0, Section 113, Sheet VI-16.226, Register 1; adressed in Albert Einstein ST N15, CEIA Building, Office 104, Álava Tech Parque Park, 01510 Miñano-Vitoria, Álava, Spain; entity where shall be submitted any notification or communication in relation with this contest.

AWARDS

Awards will be the following:

–        Winner: The winner shall receive 1.000 euros in cash and shall be entitled to purchase, completely free as well as he will receive a Wacom Intuos Pro M Special Edition pen tablet (see Wacom Intuos Pro M Special Edition). The Prize of this contest, shall not be changed or altered at winner´s request, and shall not be exchanged in cash. Just in case the prize is not available in circumstances out of Wacom control, Wacom could offer an alternative prize with equal or higher value.

–        Honorable Mention: 10 Honorable Mentions and the chance to publish a Pack of 30 graphic designs (Here and after, “BRANAS”) in Mybrana Store.

–        Special award for the most creative post: The owmer of the most creative post, with a video or photo published from Mybrana App, including at least one Brana involved in the contest, on Twitter and/or Facebook will be awarded with 100€.

 

CONTEST REGISTRATION REQUIREMENTS

1-         Participants must be 18 or over, or attend with the authorization of his/her legal mentor.

2-         Participants must design an original Bidimensional Illustration attending to the mext requirements:

           a.      Admitted files: .png with alpha transparency.

           b.      File Size: 200 kb max. ( <50 kb recommended).

           c.       Resolution: 72 p/p. 320×480 Max. Resolution.

3-         The Topic of the contest I “Asian Illustration“.

4-         Participans are able to submit as many ilustrations as they wish, submitting through the contest form in http://www.mybrana.com/contest/, using the option “Participate” and completing all the fields required in the form.

5-         Participants must be the sole owner and author of the Brana submitted to the contest. Only one person will be awarded for the winner illustration, and he/she must have the right to make his/her illustration available for the competition. Participants shall be responsable and shall indemnify for any injury to the legal owner of the submitted design, in case of potencial plagiary.

6-         For submitting Branas, users must previously register in www.mybrana.com , by filling required fields in registration form, accepting the personal information assignment clause, the Terms and Conditions of the website, and the Contest Rules.

7-         Right assignment clause for promotional purpose: The involvement in this contest means the promotional assignment of the Works, images, voice and name, that could be obtained during the several activities performed within promotional scope of the contest. This way, Mybrana will be able to use the works, images, voice and name, directly, or give them in to thirth parties such as magazines or publishers with the same promotional aim, to be used in any media. However, this will not mean, anyway, author´s renounce to his/her authority rights.

8-         Revenues for the marketing of selected Branas by Mybrana, will be shared between the awarded author and Mybrana. Mybrana reserves the exclusive right to market, use and share, Branas registered in the contest, as well as register then as a model  or industrial design, being able to use them for Mybrana purposes. Just in case Branas are marketed, Mybrana will reward the author with the 50% of the revenues for his/her design, after taxes and commisions of thirth parties (such as Apple Store, Google Play, Amazon…) are deducted. Mybrana reserves the right to choose the final customer prize, that could be free.

9-         In case the author of the Brana is enrolled in any of the educational programs of the entities that collaborate as partners on this contest, or has finished his/her studies within 2014-2015, the author shall have the right to 80% of the revenues from the sales of their Branas, after taxes and commisions of thirth parties (such as Apple Store, Google Play, Amazon…) are deducted. 

SELECTION PROCESS

 1.     Mybrana will be able to reject any of the registered design or content (Images or text), in case it

a.     Potencially or actually infringes any third party´s copyright(s), trademarks, contract right, or any other intelectual property rights of any third person or entity, or violate any person´s rights of privacy or publicity.

b.     Contains any unauthorised, obscene, unlawful or objectionable material or any sexually explicit or inappropiate content.

c.     Does not fall within the entry requirements in these Official Rules.

d.     Does not follow the topic of the contest.

2.     Branas registered in contest, will be included in Mybrana 3D app, and will be available for users of this mobile app.

3.     It will be accounted as 1 vote for each Brana, every single photo or video shared by every user from Mybrana App, using at least one Brana registered in the contest, and in any of the following social networks: Facebook or Twitter.

4.     It will  be considered as a valid vote for each Brana, any video with more than one Brana registered in the contest.

5.     Voting closes 05/10/2015 at 00:00 CET.

6.     Once voting is closed, a Jury defined by Mybrana will choose the winners between the 30 Branas with more valid votes.

7.     Mybrana reserves the right to choose other participants for any other kind of complementary award.

8.     Mybrana reserves the right to invalidate the contest, just in case Mybrana consideres that registered Branas do not reach a minimun quality requirement, or in case the number of participants is less than 100.

AWARDS

Once the Jury, which will be known during the contest, has chosen the winners, we will publish the names of the winners, in www.mybrana.com, as well as by e-mail to each awarded.

Winners must confirm and accept the award replying the mail received within 48 hours since the confirmation e-mail is sent.

If the winner could not be contacted, refuse the award or could not fulfill these Official Rules, Mybrana reserves the right whether to declare the contest as null, or to declare as winner to the second classified according to Jury´s veredict.

If the winner is located in an European country, WACOM EUROPE Gmbh. VAT Number: DE 120692751, and addressed in Europark Fichtenhain A9, D-47807 Krefeld, Germany, will send the Wacom device, completely free, to the address declared for the winner in his/her acceptance award mail, witihin the six next weeks since the award acceptance. If the winner is not located in a European country, Mybrana shall send the award provided by Wacom, without any cost for the winner.

Once the prize is sent, neither Mybrana or Wacom Europe will be responsable in case the prize is lost or damaged during the delivery.

FRAUD DETECTION

Mybrana reserves the right to exclude those users suspect for misleading participate, and reserves the right to request any kind of information to avoid any suspicion. The denial to send requested information means the automatic exclusion of the contest.

 

ORGANIZER LIABILITY

Mybrana declines any liability for damages o injuries caused to  participants in relation with the use of any content, product or service at the disposal of other websites.

Requested information shall not contain any content or statement that infringes or violates third parties rights. Any kind of threats, illegal content, defamations that involve any privacy or rights injury are strictly forbidden, as well as inappropiate content that involves any civil or criminal liability, such as illustrations which could be considered as sexual, religious or political inappropiate content. Mybrana shall not be responsable for opinions, statements or advisory published by participans at any media.

Modifications and amendments: Mybrana reserves the right to modify or add changes about the developement and contest awards, when it is considered as justified, and it can not be considered as an injury to the participants.  These changes shall be properly communicated.

Mybrana shall not be liable for the delay, lost or any problem with the deliveries that may occur. Organizer shall not be liable for reasons of force majeure, (as strikes, and so on…) that could inhibit the delivery of any award. Mybrana shall be exent of liability in any of these circumstances.

In case this promotion could not be performed, because of frauds detected, technical mistakes, or any other reason out of the control of Mybrana, and that could affect the performance of the promotion, Mybrana reserves the right to cancel or modify the promotion, including participation.

 

PROTECTION OF PERSONAL INFORMATION.           

Participants authorize that the personal information provided is included in a file whose owner is Mybrana. This personal information will be used to manage the promotional Contest, to contact the winners, to deliver the awards and to send them further information. This information will be confidently managed and according to the spanish Ley Orgánica 15/1999 de Protección de Datos de Carácter Personal (LOPD).

Participants assure the thruthfullness, accuracy and validity of the personal information provided.

The owner of the information will be able to use his/her right to Access, change or cancel, applying to the next address: Calle Albert Einstein, Edificio CEIA, oficina 104, Parque tecnológico de Álava 01510 Vitoria-Gasteiz (España), with a copy of his D.N.I indicating as issue “Ref.
